Terms of Service
Please read these Terms of Service (“Terms”) carefully. They contain important information about orders, payment, delivery, legal warranties and limits on liability. By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. About Auvessia
Auvessia is a trading name operated by RandomGoodies, a business registered in the Netherlands with the Dutch Chamber of Commerce under number 72584564 and VAT identification number NL002389879B39. In these Terms, “Auvessia,” “we,” “us” and “our” refer to the operator of the store. Shopify provides the commerce platform that enables us to offer the website, content, features, products and related services (together, the “Services”).
2. Geographic Scope
These English-language Terms are prepared for orders delivered within Canada, excluding Québec. The current store does not accept orders for delivery to Québec. Québec requires French-language consumer contracts and related documents to be provided before a customer may choose another language. We will update our store and policies before intentionally offering delivery there.
3. Eligibility and Accounts
You must be at least the age of majority in your province or territory to place an order. If you permit a minor to use a device or account you control, you remain responsible for that use to the extent permitted by law.
Information you provide must be current, complete and accurate. You are responsible for protecting account credentials and for activity carried out through your account. You may not sell, transfer or license your account. We may suspend or restrict an account where reasonably necessary to investigate fraud, misuse, security concerns or a violation of these Terms, subject to applicable law.
4. Products and Website Information
We take reasonable care to describe products accurately. Colours and appearance may vary because of screen settings, lighting and photography. Measurements are approximate unless stated otherwise. Product availability may change without notice.
Some website copy, graphics or lifestyle imagery may be created, edited or enhanced with artificial-intelligence tools as described in our Legal Notice. AI assistance does not permit a materially misleading product representation and does not limit your legal rights. The product-specific description, variant, size information and price presented for review at checkout form part of your order.
5. Orders and Contract Formation
Product listings are invitations to submit an order unless applicable law treats a specific listing as a binding offer. By placing an order, you offer to purchase the selected products on these Terms. An automated acknowledgement confirms receipt but does not necessarily mean that the order has been accepted. Unless mandatory law provides otherwise, acceptance occurs when we send a dispatch or express acceptance confirmation.
We may decline an order before acceptance for a legitimate reason, including unavailable inventory, inability to verify payment, suspected fraud, delivery restrictions or an obvious error. If payment has been captured for an order we do not accept, we will issue a refund. Nothing in this section authorizes us to cancel a binding consumer contract where applicable law requires fulfilment or another remedy.
Review your order carefully before submitting it. Contact us promptly if you notice an error. Changes or cancellations may not be possible after processing begins.
6. Prices, Taxes and Other Charges
Unless the website clearly states otherwise, prices are displayed in Canadian dollars (CAD). The price applicable to an accepted order is the price shown in the checkout review and order confirmation, subject to correction only where permitted by law.
Applicable sales taxes, shipping charges and other amounts will be disclosed before you submit the order. We will not add an undisclosed mandatory non-government charge to an advertised price. Customs duties, import taxes or government-imposed charges that cannot be calculated or collected by us may be assessed by authorities or a carrier, as explained before purchase where applicable.
7. Payment and Billing Information
You authorize us and our payment providers to charge the payment method selected at checkout for the disclosed total. You represent that you are authorized to use the payment method and that the billing information supplied is accurate. Payment services are provided by third parties and may be subject to their terms and privacy notices.
8. Promotions and Discount Codes
Promotions may be governed by additional terms disclosed with the offer. Unless stated otherwise, discount codes cannot be combined, have no cash value and apply only during the stated period. We may correct or withdraw a promotion that contains an error before a binding contract is formed, but we will not use a promotion term to remove a mandatory consumer right.
9. Shipping, Delivery and Risk
Processing and delivery estimates are provided in our Shipping Policy and at checkout. They are estimates unless we expressly promise a fixed date. We will make reasonable efforts to meet the stated timeframe and will communicate material delays when practicable.
Auvessia remains responsible for the order until it is delivered to the delivery address or recipient designated in the order, except where you independently arrange a carrier not offered by us or applicable law provides otherwise. If an order is lost or damaged before delivery, contact us so we can investigate and provide the remedy required by our policies and applicable law.
10. Returns, Exchanges and Refunds
Returns, exchanges and refunds are governed by our Refund Policy, which forms part of these Terms. The Refund Policy supplements and does not limit legal warranties or mandatory consumer remedies.
11. Legal Warranties and Consumer Rights
Products may be covered by legal warranties and conditions that arise under the consumer protection or sale-of-goods laws of your province or territory, including requirements that goods be of acceptable quality, fit for disclosed purposes and match their description. These rights may apply in addition to any voluntary policy or manufacturer warranty and cannot be excluded where the law makes them mandatory.
12. Reviews, Photos and Other User Content
If you submit a review, photo, comment or other content, you confirm that it is truthful, based on genuine experience where represented as a review, does not infringe another person’s rights and is not unlawful, defamatory, deceptive or harmful. You retain ownership of your content but grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, adapt for formatting and use it in connection with the Services and Auvessia marketing, subject to applicable law and our Privacy Policy.
We may moderate or remove user content for a legitimate reason, including violation of these Terms. We do not promise to publish every submission. Incentivized reviews will be identified where required and we will not publish fabricated reviews as genuine customer experiences.
13. Intellectual Property
The Services and their original content, branding, layout and materials are owned by or licensed to Auvessia to the extent protected by law. Third-party names, trademarks, product content and other materials remain the property of their respective owners. Some AI-assisted output may not qualify for exclusive copyright protection; no ownership is claimed beyond the rights that law or a valid licence provides.
You may use the Services for personal, non-commercial shopping. You may not reproduce, scrape, distribute, modify, sell, exploit or create derivative commercial uses of protected content without permission, except as allowed by law.
14. Acceptable Use
You must not use the Services to:
- Break a law, infringe intellectual property or privacy rights, or facilitate fraud.
- Submit false information, impersonate another person or interfere with an order or account you do not control.
- Introduce malware, probe security, overload the Services, scrape protected data or bypass access controls.
- Send unsolicited messages, harvest contact information or interfere with another customer’s use of the Services.
- Resell products or use the Services for unauthorized commercial export where we have limited orders to personal or household use.
15. Third-Party Services and Links
The Services may use or link to third-party platforms, payment services, social networks, applications or websites. We do not control independent third parties and are not responsible for their content, availability or practices. Review their terms and privacy notices before using them. This section does not limit responsibility that applicable law places on us for providers acting on our behalf.
16. Privacy and Cookies
Our collection, use and disclosure of personal information is described in our Privacy Policy. We and our service providers use cookies and similar technologies to operate the Services, remember preferences, measure performance, prevent fraud and, where permitted, support analytics and marketing.
You can control cookies through your browser settings. Where consent controls are available on the Services, you can also use them to review or change your choices. Disabling certain cookies may affect how the Services function.
17. Feedback
If you voluntarily send an idea or suggestion that is not personal information, you grant us a non-exclusive, worldwide, perpetual, royalty-free licence to use it without an obligation to compensate you. This does not transfer ownership of confidential information, user content governed by Section 12 or material protected by rights you have not agreed to license.
18. Service Availability and Disclaimer
We aim to keep the website available and information current, but the online Services may occasionally be interrupted, delayed or contain errors. To the fullest extent permitted by law, the website and non-product features are provided on an “as available” basis. We do not promise that every feature will be uninterrupted or error-free.
Products are not supplied “as is” where mandatory legal warranties apply. Nothing in these Terms excludes an express promise we make about a product or a warranty, condition or remedy that cannot lawfully be excluded.
19. Limitation of Liability
To the fullest extent permitted by law, Auvessia and its service providers will not be liable for indirect, incidental, special or consequential loss that was not reasonably foreseeable when the contract was formed and does not result from breach of a mandatory duty. Where liability may lawfully be limited, our aggregate liability arising from a particular order will not exceed the amount paid for that order.
Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, gross negligence or wilful misconduct; death or personal injury caused by negligence; breach of mandatory privacy or consumer law; or any liability that cannot lawfully be excluded or limited. Some provinces or territories do not permit particular exclusions, so those exclusions apply only to the extent lawful where you live.
20. Indemnity
To the extent permitted by law, you are responsible for reasonable losses and third-party claims caused by your unlawful use of the Services, your intentional violation of these Terms or your infringement of another person’s rights. This section does not require a consumer to indemnify us for our own breach, negligence or conduct for which we are legally responsible.
21. Suspension and Termination
You may stop using the Services at any time. We may suspend or terminate access where reasonably necessary because of fraud, security risk, unlawful conduct or a material violation of these Terms. Termination does not cancel rights or obligations that arose before termination, including payment, refund, privacy and dispute rights.
22. Severability, Waiver and Entire Agreement
If a provision is held unlawful or unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will continue. A delay in enforcing a right is not a waiver. These Terms and the policies expressly incorporated into them form the agreement concerning the Services, together with the product and price information confirmed for an order.
23. Governing Law and Disputes
These Terms and each order are governed by the laws applicable in the Canadian province or territory to which the order is delivered, together with the federal laws of Canada applicable there. Nothing in these Terms deprives you of any mandatory consumer protection or prevents you from bringing a claim before a court, tribunal or consumer forum that has jurisdiction under applicable law.
Before starting formal proceedings, we encourage you to contact us so both parties can attempt to resolve the issue informally. This is not a mandatory arbitration clause and does not shorten a legal limitation period.
24. Changes to These Terms
We may update these Terms for future use of the Services. The revised version takes effect when posted or on a later stated date. Changes do not retroactively alter an accepted order unless required by law or agreed with you. If consent to a material change is required, we will request it.
